Terms of Service

By accessing or using VisionX, an OSINT, journalism and information-based decision-making platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

This document constitutes a legally binding agreement between you and VisionX. Please read it carefully, as it governs the complete use of the Service.

Purchasing paid services, subscriptions or purchases on VisionX implies express acceptance of these Terms. The service is provided in accordance with applicable Spanish legislation.

1Service Description and Restrictions

VisionX is designed for ethical, legal and non-malicious use. You agree to use the Service only in compliance with applicable legislation. You may not use the Service in any way that infringes the rights of third parties or interferes with or limits other users' use of the Service.

2Prohibited Activities

It is strictly prohibited to use VisionX to:

  • Carry out illegal, unethical or unauthorised activities.
  • Promote, facilitate or instigate unlawful acts.
  • Violate laws, regulations or ordinances in force.
  • Infringe intellectual property rights of VisionX or third parties.
  • Harass, abuse or harm other people, including defamation or discrimination.
  • Provide false, misleading or fraudulent information.
  • Publish or carry out obscene, immoral or harmful activities.
  • Attempt to explore, scan or test vulnerabilities of VisionX networks or systems without prior written authorisation.

3Disclaimer of Warranties

Use of the Service is at your sole responsibility. VisionX is provided "AS IS" and "AS AVAILABLE". No express or implied warranties are granted, including merchantability, fitness for a particular purpose or non-infringement. We do not guarantee that the Service will operate continuously, without errors, accurately or with total security.

4Limitation of Liability

To the maximum extent permitted by law:

  • VisionX shall not be liable for direct or indirect damages, including incidental, special, consequential, punitive or exemplary damages (such as loss of profits, data or reputation), arising from use or inability to use the Service.
  • We are not responsible for actions, omissions or content generated by users or third parties.
  • We do not assume responsibility for unauthorised access to your data.
  • We shall not be liable for interruptions or failures caused by events beyond our reasonable control (including force majeure, natural disasters, power failures or network interruptions).
  • No advice or information you receive from VisionX creates any warranty not expressly provided in these Terms.

5Indemnification

You agree to indemnify and hold harmless VisionX (including its founders, affiliates, employees, legal representatives and collaborators) from any claim, damage, loss, expense or liability (including reasonable legal costs) arising from:

  • Your use of the Service.
  • Breach of these Terms.
  • Violation of third-party rights.
  • Breach of applicable laws, regulations or rules.

6Service and Feature Modifications

VisionX may modify, suspend or interrupt the Service, or any of its features, at any time, without prior notice. Some features may be subject to maintenance, limited availability or usage restrictions.

Features that depend on credits may be affected by the balance available in the user's account. VisionX reserves the right to limit features based on use or credit availability, without prior notice.

7Third-Party Service Integration

Some VisionX features may integrate with third-party services or APIs over which VisionX has no control. We do not guarantee the availability, accuracy or reliability of these external components and are not responsible for damages arising from their use. Use of these external services is at your own risk and may be subject to additional conditions.

8Refund Policy

NO REFUND POLICY: All sales are final and no refunds will be issued under any circumstances.

VisionX does NOT offer refunds for services, subscriptions, credits or purchases made. By making any purchase or subscription on VisionX, you expressly acknowledge and accept that:

  • No refunds will be given for lack of satisfaction with the service.
  • No refunds will be given for technical issues, service interruptions or connection problems.
  • No refunds will be given for subscription cancellation, even if cancelled before the end of the paid period.
  • No refunds will be given for unused credits or unclaimed subscriptions.
  • No refunds will be given for changes in features, prices or service terms.
  • No refunds will be given for any other reason, unless expressly required by applicable law.

By completing any purchase or subscription, you confirm that you have read, understood and accepted this no-refund policy. Please ensure you are fully satisfied with your decision before making any purchase.

VisionX will make transaction documentation (receipt, proof or invoice, as applicable) available to the user via email or account area, in accordance with applicable regulations.

Nothing in this refund policy limits any rights granted to you by mandatory applicable law, in particular as a consumer in the European Union or Spain (including statutory withdrawal periods or exceptions, or legal guarantees).

9Subscription and Cancellation

VisionX subscriptions renew automatically at the end of each billing period. To avoid future charges, you must cancel your subscription from your account before the renewal date. If you do not, it will renew automatically and you will be responsible for applicable charges.

10User Responsibility and Regulatory Compliance

You are responsible for ensuring your use of the Service complies with applicable legislation in Spain and the European Union. VisionX does not promote illegal or unethical activities. You are also responsible for verifying the accuracy and legality of any information obtained through the Service.

11Data Protection and Privacy

VisionX complies with the General Data Protection Regulation (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection and Digital Rights (LOPDGDD). However, no system is completely secure. By using the Service, you accept that VisionX will not be liable for unauthorised access to your information. You must report any security incident immediately.

12Access Termination

VisionX reserves the right to suspend or cancel your access to the Service at any time, without prior notice, for any reason, including breach of these Terms. In case of cancellation, you will lose all rights associated with use of the Service and no refunds will be issued.

12.1Account Deletion and Data Loss

When you request account deletion, all your data, history and content will be permanently and irreversibly deleted. This action is final and cannot be undone. You expressly accept this total loss of access and data when proceeding with deletion.

13Accuracy and Reliability of Information

VisionX does not guarantee that information or data available through the Service is accurate, reliable or complete. All information provided is for informational purposes only, and you are responsible for verifying it before making decisions based on it.

14Use of Automated Systems

VisionX is not responsible for errors, crashes or malfunctions caused by bots, scripts or other automated systems that interact with the platform. It is your responsibility to ensure such systems operate properly. You must also report any failure or error without delay.

15Confidentiality and User-Provided Data

VisionX may store or process data you provide during use of the Service. Although we apply reasonable security measures, we cannot guarantee absolute confidentiality. All content you submit is at your own risk.

16Severability

If any clause of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force. The invalid clause shall be replaced by a valid provision that most closely resembles the original intent.

17Entire Agreement

These Terms, together with any additional policy or rule published by VisionX, constitute the entire agreement between you and VisionX, superseding any prior communication or agreement, whether oral or written.

18Applicable Law and Jurisdiction

These Terms are governed by Spanish law. Any dispute related to these Terms or use of the Service shall be resolved by the competent courts of Madrid, Spain, unless another jurisdiction is required by law.

19Changes to Terms

VisionX may modify these Terms at any time. Any change will be effective once published. Continued use of the Service after modification implies your acceptance of the new Terms. If you disagree, you must stop using the Service.
